Complaints Procedure
Informal procedure
Anyone who experiences a problem with their web service provided by IWebGuy should raise the matter directly using our online contact form to do so, giving sufficient information to locate the material (such as an url) and clearly outlining the grounds for complaint.
IWebGuy will approach the individual responsible for the material in question with a view to resolving the matter to the satisfaction of the complainant.
Formal complaints procedure
The formal complaints procedure should only be used where the complainant feels that the nature of the complaint is too serious to be dealt with informally, or where a satisfactory conclusion has not been reached after following the informal procedure.
A formal complaint should be made in writing to IWebGuy, who will acknowledge receipt and ensure that the matter is looked into as soon as possible.
An initial response to any complaint can be expected within seven days of its receipt; a full and considered response to the complaint should be completed within 30 days and any subsequent remedy implemented with a minimum of delay.
Billing Policy
Invoices are sent out 15 days before they are due. It is the responsibility of CLIENT to keep the billing address current. Delinquent bills will be assessed a $15 charge if payment is not received by the due date. If an amount remains delinquent 15 days after its due date, an additional 5% penalty will be added for each month of delinquency. IWebGuy reserves the right to remove web pages from viewing on the Internet until final payment is made. In case collection proves necessary, the CLIENT agrees to pay all fees incurred by that process. There will be a $25 service charge for all returned checks.
Collection Fees
Accounts that are not collectable by IWebGuy may be turned over to an outside collection agency for collection. If you desire to cancel your account, please send a written request to info@iwebguy.ca.
Refund and Disputes
All payments to IWebGuy are non-refundable with the sole exception being the hosting fees for the first 30 days of service. Non-refundable items also include the one-time setup fee (if imposed), domain name and SSL registration fees, etc. All overcharges or billing disputes must be reported within 30 days of the time the dispute occurred.
$200 will be charged in the event a client requires us to take their live website offline & upload it again after 15 days.
Payment of Accounts
ALL PAYMENTS TO IWebGuy ARE NON-REFUNDABLE AFTER 30 DAYS & THERE WILL BE NO CHARGE BACKS.
For website hosting, payment is due each month for monthly subscribers or on each year for yearly subscribers. If payments are not made within 60 days of due date, IWebGuy reserves the right to replace your website with a "site down" message due to non payment.
For domain names 100% of the bill is due with your order. A deposit is required from any new client before any work is carried out. It is IWebGuy's policy that any outstanding accounts for work carried out by IWebGuy or its affiliates are required to be paid in full, no later than 30 days from the date of the invoice unless prior arrangements are made with IWebGuy.
Once a deposit is paid and work completed you are obliged to pay the balance of payment in full. We will contact clients via email and telephone to remind them of such payments if they are not received when due.
If accounts are not settled and IWebGuy has not been contacted or agreed to the purpose regarding the delay, access to the related website may be denied and web pages removed. We will then pass such cases to collection agencies to pursue payment. Non-payment can result in a client’s bad credit rating.
Following consistent non-payment of an invoice our solicitors will contact the client in question with a view to taking the matter further. If need be we will seek payment through legal procedures which could even include a court summons.
Liability
Each client acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, each client agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company. Client further acknowledges that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by Client for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.
Other
IWebGuy will not sell personally-identifiable information to third parties, unless stated at the time of collection. We may share information with business partners. We are committed to giving you the choice whether or not we use your information for marketing purposes or share information with business partners.
The following are some examples of times when IWebGuy may require that you provide personally-identifiable information: - to complete an online order for a product or service (if you do not wish to complete an online order form, we will always provide an option for you to complete an order by mailing us.) - to request more information about new or current IWebGuy products or services
If you do not want your personally-identifiable information collected, please do not submit it to us. If you have already submitted this information and would like for us to remove it from our records, please contact us at info@iwebguy.ca e-mail address. We will use reasonable efforts to delete your information from our existing files.
